Terms and Conditions

Revision Policy:
Revision turnaround time is typically 1-2 working days. Artisan Web Studio provides unlimited revisions on selected packages only. Revisions shall be provided according to policy within 10 working days. Once the time lapse, no further revisions shall be provided. Customers may ask for revisions as per the package and no additional fees will be applied, however, design and concept remains same. Unlimited revisions require that the initial design and concept have to be the same, customer cannot ask for a redesign once an initial concept has been selected. If the customer is not able to respond on a revision to be reviewed, changed, or amended within 48 hours, the company will not be liable for the revision. Customer is liable to make additional payment in case of further changes after the delivery date. However, it is mandatory for the customer to make full payment by the end of delivery date for further changes to be made.

Refund Policy:
Artisan Web Studio ensures 100% customer satisfaction with our unlimited free Revision Policy which enables you to improve on your initial design brief free of charge through your account area. In case of any duplicate charge due to processing error, failing to fulfill any of your special designing requirements or not able to complete your design order as per the delivery policy, your complete design order amount will be refunded. In case of any dissatisfaction from any design services provided by Artisan Web Studio, you can submit a refund request within five days of your initial designs completion. However, it shall be assumed between both parties that you are satisfied with your initial designs if a refund request is not received within five days of initial designs delivery. For any special or featured packages, refund will be applicable the same as it is on the single packages. Once the project has been entered in revision phase or exceed the number of designs in the purchased package, the refund offer will be void and a request for refund will not be entertained.

Your refund would be processed as per the chart below:
If request for refund is made before the order delivery, you would be eligible for Full Refund (less 10% service & processing fee). If request for refund is made within 48 hours of the initial design delivery, you would be eligible for 66% refund (less 10% service & processing fee). If request for refund is made between 48- 120 hours of the initial design delivery, you would be eligible 33% refund (less 10% service & processing fee). No refund request will be entertained after 120 hours of your initial design delivery, however since we believe in 100% customer satisfaction you are encouraged to contact us in case of any concern. All refund requests should be communicated to the support department. Artisan Web Studio, based on the violation of your user agreement reserves the right to approve/disapprove your request on an individual case to case basis.

How to claim your refund:
Claim your refund specifying your concern by contacting us via phone, chat or email.
We will try to resolve your concern by virtue of our revision policy immediately or else will email you a refund request approval from our refund department. After the refund, your design rights would be obtained by Artisan Web Studio and you would not be able to display any version of the design sent by company.

Let us also specify that:
Since the design rights would now be transferred to the company, you agree that you will have no right (direct or indirect) to use any response or other content, work product or media, nor will you have any ownership interest in or to the same. Working in collaboration with the Government Copyright Agencies, Artisan Web Studio would share Copyright Acquisition information for the refunded designs that would restrict the re-use of the designs as original designs in the future.

Delivery Policy:
All design order files are delivered to Account Area as per the date specified on the “Order Confirmation”. An email is also sent to inform the client about their design order delivery made to their specific account area. All policies pertaining to revision & refund are subject to date and time of design order delivered to client’s account area. We deliver all our customized design orders via email within 2 to 3 days of receiving your order.

Ownership of the Work:
Once artwork is approved and the final file is sent to the client and after final payment has been completed, the client then owns all related files, database and artwork associated with the given website. Mastersitedesign retains the right to use the logos solely as promotional material, including as part of our portfolio, and should under no circumstances sell, or use for profit other than specified by the client unless explicitly authorized by the client. The client is assigned rights to use the design, graphics, and text contained, logos and explanations at his discretion. Mastersitedesign should use the logos in a fair and legal manner which does not damage the client’s reputation and integrity.

Record Maintenance:
We keep a record of your finalized design once we provide you the final files. If you require the final files again in the future we can send them to you at your request.

Communication Policy:
You agree that Artisan Web Studio is not liable for any correspondence from email address(es) other than the ones followed by our own domain i.e. “..@artisanwebstudio.net” or/and any toll free number that is not mentioned on our website. Mastersitedesign should not be held responsible for any damage(s) caused by such correspondence. We only take responsibility of any communication through email address(es) under our own domain name or/and via toll free number i.e. already mentioned on Mastersitedesign Website.

The following terms and conditions apply to all website development / design services provided by Artisan Web Studio to the Client.

1. Acceptance:
It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.Please read these terms and conditions carefully. Any purchase or use of our services implies that you have read and accepted our terms and conditions.

2. Charges:
Charges for services to be provided by Artisan Web Studio are defined in the project quotation that the Client receives via e-mail. Quotations are valid for a period of 30 days. Artisan Web Studio reserves the right to alter or decline to provide a quotation after expiry of the 30 days. Unless agreed otherwise with the Client, all website design services require an advance payment of a minimum of fifty (50) percent of the project quotation total before the work is supplied to the Client for review. A second charge of twenty five (25) percent is required after the development stage, with the remaining twenty five (25) percent of the project quotation total due upon completion of the work, prior to upload to the server or release of materials.Payment for services is due by online payment. You will be provided with a secure online payment link hosted by top-online gateways (2checkout, Stripe, PayPal, or others) and should be made payable to Artisan Web Studio or its nominee.

3. Client Review:
Artisan Web Studio will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies Artisan Web Studio otherwise within ten (10) days of the date the materials are made available to the Client.

4. Turnaround Time and Content Control:
Anax Designs will install and publicly post or supply the Client’s website by the date specified in the project proposal, or at date agreed with Client upon Artisan Web Studio receiving initial payment, unless a delay is specifically requested by the Client and agreed by Artisan Web Studio In return, the Client agrees to delegate a single individual as a primary contact to aid Artisan Web Studio with progressing the commission in a satisfactory and expedient manner.During the project, Artisan Web Studio will require the Client to provide website content; text, images, movies and sound files.

5. Failure to provide required website content:
Artisan Web Studio is a small business, to remain efficient we must ensure that work we have programmed is carried out at the scheduled time. On occasions we may have to reject offers for other work and enquiries to ensure that your work is completed at the time arranged. This is why we ask that you provide all the required information in advance. On any occasion where progress cannot be made with your website because we have not been given the required information in the agreed time frame, and we are delayed as result, we reserve the right to impose a surcharge of up to 25%. If your project involves Search Engine Optimization we need the text content for your site in advance so that the SEO can be planned and completed efficiently.

If you agree to provide us with the required information and subsequently fail to do within one week of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately. Simply put, all the above condition says is do not give us the go ahead to start until you are ready to do so.

NOTE: Text content should be delivered as a Microsoft Word, email (or similar) document with the pages in the supplied document representing the content of the relevant pages on your website. These pages should have the same titles as the agreed website pages.

6. Payment:
Invoices will be provided by Artisan Web Studio upon start and completion. Invoices are normally sent via email. Invoices are due upon receipt. Accounts that remain unpaid thirty (30) days after the date of the invoice will be assessed a service charge in the amount of the higher of one and one-half percent (1.5%) or $30 per month of the total amount due.

7. Additional Expenses:
Client agrees to reimburse Artisan Web Studio for any additional expenses necessary for the completion of the work. Examples would be purchase of special fonts, stock photography etc.

8. Web Browsers:
Artisan Web Studio makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer 8 & 9, Google Chrome, etc.). Client agrees that Anax Designs cannot guarantee correct functionality with all browser software across different operating systems. Artisan Web Studio cannot accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website have been designed and handed over to the Client. As such, Artisan Web Studio reserves the right to quote for any work involved in changing the website design or website code for it to work with updated browser software.

9. Default:
Accounts unpaid thirty (30) days after the date of invoice will be considered in default. If the Client in default maintains any information or files on Artisan Web Studio’s Web space, Artisan Web Studio will, at its discretion, remove all such material from its web space. Artisan Web Studio is not responsible for any loss of data incurred due to the removal of the service. Removal of such material does not relieve the Client of the obligation to pay any outstanding charges assessed to the Client’s account. Clients with accounts in default agree to pay Artisan Web Studio reasonable expenses, including legal fees and costs for collection by third-party agencies, incurred by Artisan Web Studio in enforcing these Terms and Conditions.

10. Termination:
Termination of services by the Client must be requested in a written notice and will be effective on receipt of such notice. E-mail or telephone requests for termination of services will not be honored until and unless confirmed in writing. The Client will be invoiced for work completed to the date of first notice of cancellation for payment in full within thirty (30) days.

11. Indemnity:
All Artisan Web Studio services may be used for lawful purposes only. You agree to indemnify and hold Artisan Web Studio harmless from any claims resulting from your use of our service that damages you or any other party.

12. Copyright:
The Client retains the copyright to data, files and graphic logos provided by the Client, and grants Artisan Web Studio the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client is further responsible for granting Artisan Web Studio permission and rights for use of the same and agrees to indemnify and hold harmless Artisan Web Studio from any and all claims resulting from the Client’s negligence or inability to obtain proper copyright permissions. A contract for website design and/or placement shall be regarded as a guarantee by the Client to Artisan Web Studio that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested.

13. Standard Media Delivery:
Unless otherwise specified in the project quotation, this Agreement assumes that any text will be provided by the Client in electronic format and that all photographs and other graphics will be provided in high quality and resolution suitable for the project.

14. Design Credit:
A link to Artisan Web Studio will appear in either small type or by a small graphic at the bottom of the Client’s website. If a graphic is used, it will be designed to fit in with the overall site design. If a client requests that the design credit be removed, a nominal fee of 10% of the total development charges will be applied. When total development charges are less than $5000, a fixed fee of $500will be applied. The Client also agrees that the website developed for the Client may be presented in Artisan Web Studio’s portfolio.

15. Access Requirements:
If the Client’s website is to be installed on a third-party server, Artisan Web Studio must be granted temporary read/write access to the Client’s storage directories which must be accessible via FTP. Depending on the specific nature of the project, other resources might also need to be configured on the server.

16. Post-Placement Alterations:
Artisan Web Studio cannot accept responsibility for any alterations caused by a third party occurring to the Client’s pages once installed. Such alterations include, but are not limited to additions, modifications or deletions.

17. Domain Names:
Artisan Web Studio may purchase domain names on behalf of the Client. Payment and renewal of those domain names is the responsibility of the Client. The loss, cancellation or otherwise of the domain brought about by non/late payment is not the responsibility of Artisan Web Studio The Client should keep a record of the due dates for payment to ensure that payment is received in good time.

18. General:
These Terms and Conditions supersede all previous representations, understandings or agreements. The Client’s signature below or payment of an advance fee constitutes agreement to and acceptance of these Terms and Conditions. Payment online is an acceptance of our terms and conditions.

19. Social Media Management:
Social Media Marketing and Management is defined as helping a client to promote their products or services through social media channels. Artisan Web Studio will honor the components of your chosen social media package, providing an agreement to a minimum 3 months contract is served and monthly payments are received in advance. In the event that payment is not received on time, we regret that further work will be halted until this is rectified.

20. Governing Law:
This Agreement shall be governed by US Law.

21. Liability:
Artisan Web Studio hereby excludes itself, its Employees and or Agents from all and any liability from:

  • Loss or damage caused by any inaccuracy;
  • Loss or damage caused by omission;
  • Loss or damage caused by delay or error, whether the result of negligence or other cause in the production of the web site;
  • Loss or damage to clients’ artwork/photos, supplied for the site. Immaterial whether the loss or damage results from negligence or otherwise.


22. Severability:

In the event any one or more of the provisions of this Agreement shall be held to be invalid, illegal or unenforceable, the remaining provisions of this Agreement shall be unimpaired and the Agreement shall not be void for this reason alone. Such invalid, illegal or unenforceable provision shall be replaced by a mutually acceptable valid, legal and enforceable provision, which comes closest to the intention of the parties underlying the invalid.

23. Changes to the Original Scope of Work:
The client will be provided with 3 changes (minor changes) in total to the project. If the number of changes increase, the client will be charged for the said changes. Our top-priority during the project will be completion of the project with quality and time.
